NEPA Implementation – Passage

Description: 

Passage of the joint resolution that would provide for congressional disapproval of the April 2022 Council on Environmental Quality rule modifying regulations related to federal permitting requirements under the National Environmental Policy Act, including to remove a requirement that agencies base the "purpose and need" of a proposed action on the goals of an applicant and the agency's statutory authority; remove a requirement that agency NEPA procedures may not impose additional requirements beyond those set forth by the CEQ; and modify the regulations' definition of "effects" to include direct, indirect and cumulative effects. The rule took effect on May 20, 2022. It generally reversed a July 2020 rule and reinstated requirements preceding that rule. Under the provisions of the joint resolution, the 2022 rule would have no force or effect.
